Disposal of Waste Tires Bond - Jacksonville, FL in Florida

Brief Summary

Jacksonville will not license a waste tire transporter until the $25,000 performance bond is in hand. It is one of five documents the license application calls for, and we write it payable to the City of Jacksonville so it drops straight into your filing with the Solid Waste Division.

Anyone who transports more than eight waste tires in Jacksonville and Duval County must hold a transporter license from the Chief of the Solid Waste Division and maintain a $25,000 performance bond payable to the City (Jacksonville Ordinance Code Sections 260.201 and 260.203). The bond answers for violations of Chapter 260, Disposal of Waste Tires. Confirm the current form, fee and filing steps with the Solid Waste Division before the bond is issued.

Detailed Information About the Florida Disposal of Waste Tires Bond:

The trigger is more than eight tires

Section 260.201 requires a license from every person who transports more than eight waste tires. A waste tire is a tire that has been removed from a motor vehicle and has not been retreaded or regrooved. Chapter 260 applies throughout the General Services District. Proof of the bond is part of the license application, so the bond comes first.

Who does not post it

  • The City's Solid Waste Division pays no application fee and submits no bond.
  • The licensing section does not apply to persons who use company owned or company leased vehicles to move tire casings for retreading between company owned or company franchised retail tire outlets.

Tire dealers and generators that do not haul their own waste tires do not post this bond, but they must hand their tires only to licensed transporters. Contracting with anyone not on the City's licensed hauler list violates Section 260.501(e), and the City lists the maximum penalty as a $500 fine or 60 days in jail, or both.

What the bond guarantees

Section 260.203 requires each transporter to have and maintain a $25,000 performance bond payable to the City in the event the transporter violates any provision of Chapter 260. It is one flat amount with no tiers. Failing to maintain a valid bond is grounds for revocation under Section 260.204, after 15 days written notice and an opportunity for a hearing.

What else the license requires

Along with the bond, the application needs proof of a business tax license, proof that you own or lease a qualifying lot, a tire storage permit from the Chief of Fire Prevention, and a Certificate of Use. The lot must be at least one acre, owned or under a lease of at least one year, for outdoor storage, and at least five acres for outdoor processing. Storage on a smaller lot must be in an enclosed facility. A nonrefundable application fee applies, set on the City fee schedule.

Once licensed, you must mark every vehicle used to haul tires in letters at least two inches high, keep tires on an outdoor storage lot no more than 15 consecutive days, haul only between 7:00 a.m. and 6:00 p.m. Monday through Saturday, and keep records of how many tires you collected, where and from whom, and where you deposited them.

State rules sit alongside the City bond

Florida Statutes 403.717 provides for registration of waste tire collectors with the Department of Environmental Protection, with a fee of no more than $50 per vehicle registered annually, and for financial assurance standards for waste tire collectors, collection centers and processing facilities. The City bond is a local requirement filed separately with the Solid Waste Division.

Eligibility and Requirements for a Florida Disposal of Waste Tires Bond:

  • Bond amount of $25,000, one flat figure.
  • City of Jacksonville named as obligee.
  • Bond maintained for as long as you hold the license. A lapse is grounds for revocation.
  • Vehicles marked in letters at least two inches high.
  • Records of tires collected, where and from whom, and where they were deposited.

Florida Disposal of Waste Tires Bond FAQs:

I run a tire shop. Do I need this bond?

Not if you only generate waste tires and hand them off. The bond is for licensed transporters. As a dealer or generator you must use a transporter on the City's licensed list, because contracting with anyone else violates Section 260.501(e).

We move casings between our own stores for retreading. Do we need a license?

Section 260.201 does not apply to persons who use company owned or company leased vehicles to transport tire casings for retreading between company owned or company franchised retail tire outlets.

What happens if my bond lapses?

Failure to maintain a valid bond is grounds for revocation under Section 260.204. The Chief must give 15 days written notice and an opportunity for a hearing before revoking.

How long can I keep tires on my storage lot?

No more than 15 consecutive days on an outdoor temporary storage lot (Section 260.207).

Is there a state requirement too?

Florida Statutes 403.717 provides for waste tire collector registration with the Department of Environmental Protection, at no more than $50 per vehicle registered annually, and for financial assurance standards set by rule. Check those state steps separately from the City bond.
