Right of Way Permit Bond - City of Cherry Hills Village, CO in Colorado

Brief Summary

Cherry Hills Village asks for one original bond per right-of-way permit, and riders on an existing bond are not accepted. A surety bond lets you post the $5,000 the city lists for each permit without leaving cash with the city for two years after the job is accepted.

Cherry Hills Village Municipal Code 11-2-120 requires a bond or letter of credit before any public right-of-way permit is issued. The code sets it at the total cost of construction or $5,000, whichever is greater, with a $10,000 minimum for trail permits. The city's permit checklist lists a two year, $5,000 bond for each permit and $10,000 for trail access and trail excavation. The City of Cherry Hills Village is the obligee.

Detailed Information About the Colorado Right of Way Permit Bond:

One bond for each permit

The city's ROW Permit Checklist is blunt about it. Riders on existing permits are not allowed, and you need one original bond per permit. A contractor with three street cuts in the Village posts three bonds.

How much

Municipal Code 11-2-120(a) sets the bond at the total cost of construction, including labor and materials but not the facilities being installed, or $5,000, whichever is greater. Trail permits carry a minimum of $10,000. The city's ROW Descriptions sheet lists the bond for each permit type.

  • Street cut. $500 permit fee per cut and a $5,000 two year bond per cut.
  • Street occupancy for cranes, concrete pump trucks and bucket trucks. $150 permit fee and a $5,000 bond.
  • Driveway. $150 permit fee and a $5,000 two year bond.
  • Construction access. $500 permit fee per access and a $5,000 two year bond per access.
  • Landscaping work in the right-of-way. $150 permit fee and a $5,000 two year bond.
  • Gravel road. $387.50 permit fee per cut and a $5,000 two year bond per cut.
  • Trail or park occupancy. $150 permit fee and a $10,000 two year bond.
  • Trail or park excavation. $500 permit fee per cut and a $10,000 two year bond per cut.

For other work, the city decides what bonding and insurance to require. Larger jobs may be bonded above $5,000 because the code ties the amount to construction cost.

What the bond guarantees

The bond is conditioned on the applicant fully complying with city ordinances, resolutions and regulations, and on paying judgments and costs for violations caused by negligent or wrongful acts in the permitted work. The city can sue on the bond in its own name. It must stay in force at least two years after completion and acceptance of the street cut, excavation or lane closure, which lines up with the two year warranty in Section 11-2-130. The applicant can choose a letter of credit instead, and a valid franchise agreement controls where it conflicts with this section.

What else you need

The checklist also asks for a completed application, a certificate of insurance naming the City of Cherry Hills Village as additional insured with an issue date within 30 days, and a certified traffic control plan. Code Section 11-2-100 sets general liability limits of at least $1,000,000 per occurrence for bodily injury and $500,000 per occurrence for property damage, plus workers' compensation.
