Stormwater Permit Bond - City of Cherry Hills Village, CO in Colorado

Brief Summary

Cherry Hills Village will not issue a Stormwater Construction Permit until the bond is in hand, and the amount is not a flat figure. It is $1,000 or the engineer's full cost of every BMP on the job, whichever is greater. A surety bond covers that number for an annual premium instead of tying up cash for the two years the city requires.

Cherry Hills Village requires a bond with every Stormwater Construction Permit application. The amount is $1,000 or the actual cost of all initial, interim and final BMPs, whichever is greater, and the bond must stay valid for at least two years from the project start date. The permit applies to land disturbance of one acre or more, smaller sites that are part of a larger common plan of development, and work within 100 feet of a watercourse or wetland.

Detailed Information About the Colorado Stormwater Permit Bond:

The amount depends on your BMP estimate

Most people assume this is a $1,000 bond. It is $1,000 only when the BMPs on the job cost less than that. The city's Stormwater Construction Permit Application, revised March 2024, sets the bond at $1,000 or the actual cost of construction of all BMPs (initial, interim and final), whichever is greater. The application asks for the total BMP cost with itemized costs from your engineer attached, and that figure drives the bond amount.

Who needs the permit

Chapter 19 of the Cherry Hills Village Municipal Code, Stormwater Quality and Control, makes it unlawful to start any of the following without a city stormwater permit:

  • Land disturbance of one acre or more.
  • Disturbance under one acre when it is part of a larger common plan of development or sale.
  • Construction within 100 feet of the boundaries of a watercourse or wetland tied to a final plat, special use permit, building permit or expanded use permit, regardless of the disturbed area.

Section 19-1-130(g) also lets the Director order the owner of a construction site or subdivision to post surety in a form approved by the City Attorney, and lets the city hold other permits until it is provided.

Bond terms

The city accepts a license or performance bond on a general bond form, with the City of Cherry Hills Village as obligee. It must run at least two years from the project start date. Permits are issued for a 24 month term, and projects that run longer may need to reapply and renew the bond.

Other items filed with it

The application must include an engineer stamped Stormwater Management Plan (a GESC is no longer accepted in its place), a $300 application fee and a $390 plan review fee covering two hours of City Engineer review, with $195 for each extra hour. If the site needs a state CDPHE stormwater discharge permit, that permit must be approved and submitted to the city before the city permit can issue.

What the premium depends on

The surety prices the bond from the bond amount and the applicant's credit and project history. Confirm the current form and any wording requirements with the Community Development office at (303) 789-2721 before the bond is issued.
