The $1,000 performance bond is one of the smaller items on a Forsyth beer license application, but the City Clerk needs it with the application. A surety bond costs a modest annual premium and stays with the license for as long as it is valid.
The City of Forsyth in Monroe County, Georgia requires a $1,000 personal performance bond with each application for a malt beverage or wine license under Sec. 4-48 of the city code. For a retail package malt beverage dealer, the bond guarantees compliance with all city laws, rules, regulations and ordinances and remains in force so long as the license is valid.

Stores that sell both beer and wine to go usually expect one bond. Forsyth treats malt beverage and wine as separate licenses, and Sec. 4-10(c) calls for a separate application for each business activity and each location. Since Sec. 4-48 requires the $1,000 bond with each application, a store selling both should plan on two bonds. A store adding distilled spirits needs the separate $7,000 package liquor bond as well. This is the City of Forsyth, the Monroe County seat. Forsyth County is a different government.
Sec. 4-48 reads that an applicant for any license under the malt beverage and wine division shall file a personal performance bond of $1,000 with the application to ensure compliance with all laws, rules, regulations and ordinances of the city, and that the bond remains in force so long as the license is valid. Under Sec. 4-18, City Council may forfeit all or part of the bond for a violation of Chapter 4, after at least three working days' written notice and a hearing.
Sec. 4-52 bars a malt beverage or wine license within 100 yards of a church, school, college building or a government owned alcohol treatment center. Grocery stores selling only wine and malt beverages for off premises consumption may be allowed within 100 yards of a school if the city permits it by resolution or ordinance. Businesses continuously licensed since before July 1, 1981 are exempt from the distance rule. Initial applicants and managers must also submit fingerprints.
Licenses run for the calendar year. The annual fee is set by Council resolution and is due within 30 days after approval. Renewal goes to the City Manager before the license expires. Sec. 4-19 lets Council change bond amounts and fees by resolution no later than January 31 each year, so confirm the current figure with the City Clerk before the bond is issued.
Plan on two. Malt beverage and wine are separate licenses with separate applications, and Sec. 4-48 calls for the bond with each application. Ask the City Clerk if you want to confirm how your filing will be handled.
Sec. 4-52 bars licenses within 100 yards of a church, school, college building or government owned alcohol treatment center. Grocery stores have a limited school exception, and businesses licensed continuously since before July 1, 1981 are exempt.
For as long as the license is valid. Licenses run for the calendar year and are renewed with the City Manager.
The surety prices the bond from the owners' credit and business history, and it is paid each year the bond is in force.
