Encroachment Permit Bond - City of West Sacramento, CA in California

Brief Summary

West Sacramento wants security equal to 100% of the value of your work in the public right of way before it issues an encroachment permit. Cash ties that money up until the Engineering Division finals the job. A surety bond on the City's own form satisfies the same requirement for an annual premium, so your cash stays on the project.

The City of West Sacramento requires a cash deposit, performance bond, letter of credit or other approved security before it issues an encroachment permit. The amount equals 100% of the value of the work performed within the City right of way or easement. The bond is written on the City's Encroachment Permit Bond form with the City of West Sacramento as obligee and is not released until all improvements are complete and the permit is finaled.

Detailed Information About the California Encroachment Permit Bond:

How much the bond is

There is no flat figure. The Engineering Division's general requirements sheet says the security must equal 100% of the value of the work performed within the City right of way or easement, to ensure the work is completed. A small driveway approach needs a small bond. A long frontage of curb, gutter and sidewalk needs a bond for the full value of that work.

Who needs an encroachment permit

Anyone doing work in a public street, sidewalk, curb, gutter or easement, or work that may affect those areas. The City lists curb, gutter, sidewalk and driveway construction, connections to City sewer, water and storm drain lines, backflow assemblies and cleanouts, and pool installations where equipment crosses the sidewalk. All encroachment work has to be finished before the building gets final approval and occupancy.

Work on a state highway is different. Jefferson Boulevard, Sacramento Avenue west of Jefferson and Reed Avenue are Caltrans right of way, and work there needs a Caltrans District 3 encroachment permit.

What the bond promises

The City's bond form binds the principal and surety to keep and perform every condition of the permit and to indemnify the City, its officers, agents and employees. It also covers the City's reasonable attorney fees and costs if the City has to enforce the bond, on top of the face amount. The surety waives notice of changes, time extensions or added work under the permit, so the bond follows the job as it changes.

How long it stays in place

The security is not released until all improvements are complete and the Engineering Division has finaled the permit. Separately, the permit conditions require the permittee to guarantee the work for one year after City acceptance and to fix any failure from defective materials or workmanship.

California Encroachment Permit Bond FAQs:

How is the bond amount set?

The City requires security equal to 100% of the value of the work performed within the City right of way or easement. The amount changes with each job.

Can I post cash instead?

Yes. The City accepts a cash deposit, check, performance bond or letter of credit. A letter of credit or other form besides cash or a bond needs City Attorney approval.

When is the bond released?

Not until all improvements are complete and the Engineering Division has finaled the encroachment permit. Keep the bond active until you have that final.

My project fronts Jefferson Boulevard. Is the City permit enough?

Jefferson Boulevard, Sacramento Avenue west of Jefferson and Reed Avenue are state highways. Work in the state right of way needs a Caltrans District 3 encroachment permit.

How is the premium set?

The surety prices the bond from the bond amount and a review of the principal's credit and business history. Larger amounts or weaker credit cost more.
