Five thousand dollars is the floor, not the fixed price. Englewood sizes this bond at the total cost of your right of way work or $5,000, whichever is greater, so a small curb cut posts $5,000 while a larger job posts its full construction cost. Getting the amount right before you apply keeps the permit from stalling at the counter.
Before Englewood issues a right of way permit, the applicant must file a bond or letter of credit in favor of the City equal to the total cost of construction, labor and materials included, or $5,000, whichever is greater. The bond stays in force for at least two years after the City accepts the work, under Englewood Municipal Code 11-7-9.

Englewood Municipal Code 11-7-9 requires a performance bond or letter of credit before any right of way permit is issued. The amount equals the total cost of construction, including labor and materials, or $5,000, whichever is greater. The permit application asks for an itemized estimate of restoration cost to set the bond, and the City can raise that figure if it looks low next to recent City or CDOT bids for similar work. So the $5,000 bond fits smaller jobs. Larger jobs need a bond written for the full cost.
The bond guarantees that the permit holder follows City ordinances, rules and regulations, and pays judgments and costs from material violations of City ordinances or state law, including damages caused by negligent or wrongful acts during the permitted work. The City can claim on the bond for itself or on behalf of anyone harmed. It must be signed by at least one surety that can be served with process in Colorado, and the City approves the form and the surety before the permit is issued.
This catches people off guard. The bond must remain in effect for at least two years after the work is finished and accepted by the City, matching the two year warranty in EMC 11-7-10. About 30 days before that warranty ends, the City runs a final inspection and then releases the bond or lets it expire.
Public utilities, franchised entities, and metropolitan, water and sanitation districts working in the City may file a letter of responsibility instead. The City also waives the bond for work that does not materially disturb the right of way, and it may waive the bond or accept one without surety if it finds the applicant financially stable with assets in Colorado. Permits go only to licensed and bonded contractors, or to a homeowner working at their own primary residence.
EMC 11-7-8 also requires commercial general liability coverage of at least $2,000,000 per occurrence and $4,000,000 aggregate, plus workers compensation as state law requires. A permit expires in 180 days or less. Confirm the current bond form and filing steps with Englewood Public Works before the bond is issued.
No. Englewood requires the greater of the total cost of construction or $5,000. Jobs that cost $5,000 or less post $5,000. Anything larger needs a bond for the full construction cost.
Not when the work ends. The bond must stay in force for at least two years after the City accepts the work. The City inspects again near the end of that two year warranty and then releases the bond or lets it expire.
Public utilities, franchised entities, and metropolitan, water and sanitation districts may file a letter of responsibility instead of a bond or letter of credit.
The surety prices the bond on its amount and on the applicant's credit and business history. A bond above $5,000 for a larger job costs more than the minimum bond.
