Before the Colorado Springs City Clerk will license you to dig in a public place, you need this $5,000 bond on the city's form, a $1,000,000 liability certificate and a completed Damage Prevention Safety Class certificate. The bond renews with the license, and the premium is a fraction of the cash it replaces.
Colorado Springs requires a $5,000 surety bond, on the City Clerk's Excavation License Bond form, from anyone who makes or fills an excavation in a public place. The license is governed by City Code 3.3.2, costs $110 a year, and also requires $1,000,000 in general liability insurance and proof of completing the Colorado Springs Damage Prevention Safety Class.

City Code 3.3.203 requires every excavation license applicant to complete the Colorado Springs Damage Prevention Safety Class and submit the certificate with the application, at first licensing and at renewal. Under City Code 3.3.2, no person may make or fill an excavation in any public place in Colorado Springs without first getting an excavation license and a permit. The city defines an excavation as any opening in the surface of a public place, except an opening into a lawful flush mounted substructure built to be opened often without damaging the surface. The general business license rules in City Code Chapter 2, Article 1 also apply.
The city's Excavation License Bond names the City of Colorado Springs as obligee in the penal sum of $5,000, written by a surety authorized to do business in Colorado. It guarantees that the excavator will:
The bond runs concurrent with the license and is continuous through every renewal. It stays in force until the surety cancels it with prior written notice to the Deputy Licensing Officer in the City Clerk's Office, and cancellation does not discharge liability that already accrued.
The annual license fee is $110, with a $55 late renewal fee and a $5 duplicate license fee. Licenses run one year from issuance or renewal. The packet also includes the business license application, a $1,000,000 commercial general liability certificate listing the City of Colorado Springs as certificate holder, and Secretary of State trade name and good standing records where they apply. Individual right of way permits may still be required.
The City Clerk has also published a proposed City Business License Code to replace the current general business license code, described as restructuring and non-substantive. Check the current bond form with the City Clerk before the bond is issued.
The surety sets the premium based on the $5,000 bond amount and the owner's credit.
No. The Damage Prevention Safety Class certificate under City Code 3.3.203 is an extra document. The $5,000 bond and insurance certificate are still required.
License violations, fines and penalties, a one year duty to properly backfill and maintain each excavation, and charges the city bills for permanent resurfacing, detector loops, pavement markings and other restoration of public property.
The city's form makes the bond continuous, covering the original license and every renewal until the surety cancels it with written notice to the City Clerk.
