If you only have one right-of-way job in Arapahoe County, a single job permit bond gets that permit issued without carrying a standing bond all year. The county will not accept cash or a certified check instead, so a surety bond is the practical way to meet the requirement.
Arapahoe County will not issue a street cut, right-of-way use or pothole permit until the applicant and every listed subcontractor have a permit bond and liability certificate on file. The county's rule sets the bond at $20,000 or at the estimated cost of public improvements currently permitted or under warranty, payable to the Board of County Commissioners. The bond covers county expenses caused by the work for 365 days after the permit expires.

A single job bond is not finished when the crew leaves. Arapahoe County's permit terms say the bond lets the county recover any expense it incurs within 365 days after the permit expires because the permittee failed to meet county standards or otherwise caused the county expense. Each permit also starts a one year warranty period once the inspector approves the completed work. Plan for the bond to stay in force through that period.
The county's Bonds and Insurance page requires a non-cancelable permit bond of $20,000, or the estimated cost of public improvements currently permitted or under warranty, payable to the Board of County Commissioners, Arapahoe County, in the permittee's name. Confirm with Public Works and Development which figure applies to your permit before the bond is issued.
The Street Cut, ROW Use and Pothole Permit application states that all contractors and all subcontractors listed on the permit must have a bond and a certificate of liability insurance on file before the permit is issued.
No bond is required when the work is in the scope of an approved, current development agreement such as an SIA, TSEA or IGA with collateral already posted, when a local improvement district, metropolitan district or similar entity has a valid letter of responsibility in place, or when the work is for Arapahoe County and the contractor has already provided a performance and payment bond.
The permittee must also carry property damage, public liability and bodily injury coverage of at least $400,000 each, or the higher amount in the Colorado Governmental Immunity Act, with the county named. A permit without adequate bond can be revoked immediately, and a contractor who works without one is denied future county permits until the requirement is met. The county will not accept cash deposits, certified checks or similar security in lieu of the bond.
The county can claim expenses arising within 365 days after the permit expires, and each permit carries a one year warranty after work is approved. Keep the bond in force through that window.
The county sets it at $20,000 or the estimated cost of public improvements currently permitted or under warranty. Confirm the figure for your permit with Public Works and Development.
Yes. Every subcontractor listed on the permit needs its own bond and liability certificate on file.
The surety prices the bond from the bond amount, the owner's credit and the company's history. You receive a quote after completing the application.
