Well Driller ($5,000) Bond - Tehama County, CA in California

Brief Summary

Tehama County will not issue a licensed well driller's first well permit until a $5,000 bond in the county's favor is on file and approved by county counsel. Get the bond in place before you pull that first permit and the job is not held up at the counter.

Tehama County Code section 9.42.280 requires a licensed well driller to post a $5,000 surety bond in favor of the county before the driller's first well permit in the county is issued. The surety must be a corporation authorized under California law to write bonds, and county counsel examines and approves the bond. The Environmental Health Department keeps the county's well driller bond list.

Detailed Information About the California Well Driller ($5,000) Bond:

When the bond is due

The bond is tied to your first well permit in Tehama County, not to your state license. Under Tehama County Code 9.42.280, before a licensed well driller's first permit is issued under Chapter 9.42, the driller must obtain a surety bond executed in favor of the county in the penal amount of $5,000. Chapter 9.42 covers construction, reconstruction, repair and destruction of water wells, monitoring wells and cathodic protection wells. County counsel examines and approves the bond before any permit is issued. If a personal bond is furnished instead of a corporate surety bond, it is also $5,000.

What the bond guarantees

The bond's condition is that the driller, as principal, will truly and faithfully perform all duties and obligations required by Chapter 9.42, along with the terms, conditions, orders and directions the enforcing agency considers necessary to protect human health, safety and general welfare. In practice that means building and destroying wells to the county's standards so groundwater is not contaminated.

License and monitoring well rules

The bond does not replace a license. Section 9.42.305 says no one may drill, bore, deepen or reperforate a water well, monitoring well or cathodic protection well unless the person responsible holds a C-57 water well contractor's license.

There is one alternative for monitoring wells used in environmental assessments and site mitigation. Under section 9.42.285, the responsible registered professional may submit a certification, stamped with a current registration number and wet signature, that the wells will be built so groundwater quality is not impaired or polluted, in lieu of the driller's surety bond.

Permit fees are set by the Board of Supervisors and kept on file with the Department of Environmental Health. Confirm the current fee and bond form with Environmental Health at (530) 527-8020 before the bond is issued.

California Well Driller ($5,000) Bond FAQs:

When do I need the bond?

Before Tehama County issues your first well permit under Chapter 9.42. If you have never pulled a well permit in the county, the bond comes first.

Is there an exception for monitoring wells?

Yes. For monitoring wells used in environmental assessments and site mitigation, the registered professional in charge may submit a stamped and signed certification under section 9.42.285 in lieu of the driller's surety bond.

Does the bond replace my C-57 license?

No. Section 9.42.305 requires the person responsible for drilling, deepening or reperforating a well to hold a C-57 water well contractor's license. The bond is a separate county requirement.

What does the premium depend on?

The premium is based on the $5,000 bond amount and the credit of the driller and the business owners. The quote reflects your actual file.
