Tower / Structural / Antenna / Equipment Removal Bond - City of El Centro, CA in California

Brief Summary

El Centro can make a removal bond a condition of approval for a cell tower, antenna or other communication facility. The bond amount has to track the real cost of taking the equipment down, and the City must consider your own removal estimate, so a good estimate keeps the bond and the premium in proportion.

The City of El Centro requires communication facility operators to remove all equipment within 180 days after the use stops and restore the site, and it may require a financial guarantee to back that promise. Under El Centro Code Section 29-260, the City may not demand an escrow deposit for removal of a wireless facility but may require a performance bond or other surety, in an amount rationally related to the cost of removal. The City sets the figure for each permit.

Detailed Information About the California Tower / Structural / Antenna / Equipment Removal Bond:

What this bond guarantees

This is a removal bond. Section 29-260(15) of the El Centro Code says all equipment associated with a communication facility must be removed within 180 days of the discontinuation of the use, and the site restored to its preconstruction condition. Every permit is conditioned on the operator agreeing to that removal and giving the City access across private property to do it if the operator does not. The City may require a financial guarantee acceptable to it to make sure removal happens. If the operator walks away, the City can claim against the bond to pay for taking the tower, antenna and equipment down.

How the amount is set

There is no fixed figure. Section 29-260(1) bars the City from requiring an escrow deposit for removal of a wireless telecommunications facility, but allows a performance bond or other surety as long as the amount is rationally related to the cost of removal. The City must take into account the removal cost information the applicant provides. Submit a realistic removal estimate with your application and confirm the final amount and bond form with the Community Development Department before the bond is issued.

Who is exempt

Section 29-258 exempts receive-only antennae and satellite dishes that meet zoning limits, news coverage facilities up for 72 hours or less, cells on wheels used in emergencies or approved events, testing towers up to 120 feet for 48 hours or less, and qualifying amateur radio stations. Collocations that qualify as a permitted use under Section 29-259(a) are not subject to the general requirements in Section 29-260. Facilities permitted or built before the division was adopted are not covered until they need renewal or modification.

Permit term

All telecommunication towers need a conditional use permit and a building permit. Communication facility permits other than wireless telecommunications facilities generally run three years and can be extended administratively. Keep the bond in force until the equipment is gone and the site is restored.
