Mountain Brook will not issue a blasting permit until a $100,000 surety bond is on file with the city clerk. Paying a premium for that bond costs far less than tying up $100,000, and once it is approved you can move on to the permit, the pre-blast survey and the work itself.
Any person who blasts or detonates explosives in Mountain Brook must deposit a $100,000 bond with the city clerk under Section 105-5 of the city code. The bond must be written by a corporate surety authorized in Alabama and sits alongside a separate $500,000 liability insurance policy required by Section 105-4. Your state blasting license does not replace either one.

The mistake most contractors make in Mountain Brook is assuming the insurance certificate covers the bond, or the other way around. Chapter 105 of the city code asks for both. Section 105-4 requires a liability policy of at least $500,000, with identical limits for explosion, collapse and underground coverage, kept in force for the whole permit period. The same section says the blaster must also be bonded for $100,000 for the duration of the permit, and that the policy and bond must name the city and cover people who suffer injury or property damage from the blast.
Section 105-5 sets the terms. Before anyone engages in the business of blasting or detonating explosives in the city, they obtain the proper permit or license and deposit the bond with the city clerk. It must be signed by a corporate surety authorized to do business in Alabama. The bond guarantees that you will follow every law, ordinance, rule and regulation on blasting, that the City of Mountain Brook will be held harmless from claims arising from your work or your employees' work, and that the work will be done in a good and workmanlike manner. The city council sets the bond form, a copy is kept in the city clerk's office, and the clerk approves and holds the original.
Under Section 105-3 you need a Mountain Brook business license, and at the time you apply you must show proof of state certification from the State Fire Marshal: a blaster's card for the individual and a blasting contractor's license for the company. Holding those state credentials is a prerequisite. It does not waive the city bond.
The blasting permit issuance fee is $200 under the Chapter 14 fee schedule. Section 105-7 says permits are generally issued within three days of a complete application, not counting weekends and holidays. A pre-blast survey of every building within 1,500 feet must be filed with the fire marshal's office before the first blast.
The bond stays in force until 30 days after the city clerk receives written notice that the surety intends to cancel. Liability that arose before the cancellation date stays covered. Premium is set by the surety after reviewing the owner's credit and the company's financial standing, and you can ask for a quote before you commit.
Yes. Section 105-3 makes the state license a condition of getting a city business license, and Section 105-5 separately requires the $100,000 bond before you blast in Mountain Brook. The state license does not stand in for the bond.
No. Section 105-4 requires the insurance policy and the $100,000 bond as two separate items, and both must cover the city and people injured or damaged by the blasting.
To the Mountain Brook city clerk, who approves it and keeps custody of it. The form is the one set by the city council, so get a copy from the clerk's office before the surety issues the bond.
Yes, but only with written notice to the city clerk. Coverage continues for 30 days after the clerk receives that notice, and anything that happened before the cancellation date is still covered.
You pay an annual premium, which is a fraction of the $100,000 amount. The surety sets it after looking at credit and the strength of the business, so the best way to know your number is to request a quote.
