Superheavy or Oversize Permit ($15,000) Bond - Brazos County, TX in Texas

Brief Summary

Brazos County will not issue a permit to run an overweight, oversized or overlength load on county roads until it has a bond covering damage to its roads, bridges and culverts. This $15,000 bond satisfies that requirement for a premium, without tying up cash with the county.

Brazos County requires a $15,000 surety bond from applicants for a county permit to move overweight, oversized or overlength loads that cannot reasonably be dismantled over county roads. Under the Commissioners Court order of April 26, 2022 the bond must be issued by a Texas company and must guarantee payment of damage to any road, bridge or culvert caused by the permitted move. Brazos County is the obligee.

Detailed Information About the Texas Superheavy or Oversize Permit ($15,000) Bond:

Check the exemptions first

On April 26, 2022 the Brazos County Commissioners Court adopted an order regulating overweight, oversized and overlength vehicles on county roads. The weight restrictions in that order do not apply to emergency response vehicles, vehicles used in the agribusiness industry, concrete ready mix vehicles or solid waste disposal vehicles. If your trucks fall into one of those classes, talk to the county before buying a permit bond.

The order covers county roads only. State and federal highways, and streets inside an incorporated city, are outside it.

What the bond guarantees

The county may issue permits for loads that cannot reasonably be dismantled, and it may require a bond issued by a Texas company in an amount sufficient to guarantee payment of any damage to a road, bridge or culvert caused by the permitted move. The bond on this page is $15,000. Texas Transportation Code 623.018 is the state law that authorizes county permits and bonds of this kind, and it limits a county permit to no more than 90 days.

State permit holders

Section 623.018 also says a county may not require an additional permit, fee or bond for a vehicle already operating under a permit issued under Section 623.011 or 623.402. Confirm with Brazos County which permit your move needs.

Running without a permit

Operating in violation of the order is a misdemeanor punishable by a fine of up to $500, and each violation is a separate offense.
