Cumberland will not issue a sewer connection permit to anyone who is not a licensed and bonded drainlayer or a state-licensed plumber, and both post the same $5,000 bond payable to the Town treasurer. You pay a premium instead of leaving $5,000 with the Town, and the bond keeps your name eligible on every connection permit you pull.
Section 40-93 of the Cumberland Code of Ordinances requires drainlayers and plumbers doing building sewer connection work to post a $5,000 bond payable to the Town treasurer to guarantee satisfactory completion of the work. Drainlayer licenses go only to experienced and competent contractors who can show at least five years in this line of work. A violation can cost the license and lead the Town treasurer to cash the bond.

Cumberland regulates sewer connections in Chapter 40, Utilities, Article III, Sewers, Division 2, Building Sewers and Connections. Section 40-92 says connection permits are issued only to plumbers licensed to do business in the state and to drainlayers licensed to lay drains in the Town, and permits are not transferable. Section 40-93, dating to the ordinance of January 13, 1972, sets the terms for those contractors.
The point most often missed is that the bond is not limited to drainlayers. Section 40-93(c) says such drainlayers and plumbers shall post a bond payable to the Town treasurer in the amount of $5,000 to guarantee the satisfactory completion of work. A state plumbing license does not take the place of the Town bond for sewer connection work.
Under section 40-93(a), licenses to connect building sewers to the common sewers are issued to experienced and competent contractors, and applicants must provide proof of being engaged in this line of work for at least five years. The bond does not replace that experience requirement.
Section 40-93(b) requires public liability coverage of $50,000/$100,000 and property damage liability of $50,000/$100,000, with a certificate filed with the public works department and the Town treasurer. Under section 40-93(d), a violation of the article is cause for revocation of the license or permit and the cashing of the bond by the Town treasurer.
Permits are obtained on weekdays at the office of the public works department between 9:00 a.m. and 4:00 p.m. If work under a permit is not completed within 30 days, the permit must be renewed by the public works department. The service connection fee for a single-family residence is $1,000 per equivalent dwelling unit. The Town's Application for Sewer Connection names the licensed and bonded drainlayer, and it requires the septic system to be pumped the day of and prior to connection and buried and filled the day of connection.
Confirm the current bond form and filing steps with the Cumberland Public Works/Sewer Department and the Town treasurer before the bond is issued.
The surety looks at the bond amount, the contractor's credit and its years in the trade. You pay the premium, not the $5,000 bond amount.
Yes. Section 40-93(c) requires such drainlayers and plumbers to post a $5,000 bond payable to the Town treasurer for work under the sewer article.
Section 40-93(d) makes a violation cause for revocation of the license or permit and the cashing of the bond by the Town treasurer. The surety then looks to you for repayment.
Under section 40-92, if the work is not completed within 30 days, the permit must be renewed by the public works department.
Section 40-93(a) calls for proof of at least five years in this line of work. The bond is required in addition to that experience.
