Sewer Cleaner ($10,000) Bond - City of Toledo, OH in Ohio

Brief Summary

Toledo's sewer cleaner license is not effective until a bond of at least $10,000 is on file with the Department of Public Utilities, and the license becomes void the moment that bond lapses. Every license runs out February 1, so keep the bond continuous and file the renewal in the 30 days before that date.

Toledo Municipal Code 927.14 requires anyone who cleans building sewers and connections, or uses a sewer cleaning machine, to hold a sewer cleaner's license from the Director of Public Utilities. The license is not issued or effective until the applicant files a bond of not less than $10,000 with the Department of Public Utilities, conditioned to indemnify, defend and hold the City harmless. A property owner cleaning the building sewer on the owner's own property is exempt.

Detailed Information About the Ohio Sewer Cleaner ($10,000) Bond:

Who needs the license

Toledo Municipal Code 927.14 says no person may clean a building sewer and connections, or use any sewer cleaning machine, without first getting a sewer cleaner's license. The only exemption in the section is for an owner cleaning the building sewer that lies within the owner's own property. Drain cleaning companies, plumbers who run machines and rooter services working for Toledo customers all fall under the license.

Ohio Revised Code 715.27 lets Ohio municipalities license trades such as sewer tappers and vault cleaners, and Toledo licenses sewer work through Chapter 927 of its Municipal Code.

The bond amount is a floor

The code requires a bond in the sum of not less than $10,000. The license is not issued and does not become effective until the bond is filed with the Department of Public Utilities. The bond is conditioned on the applicant's promise to indemnify, defend and save harmless the City from any loss or damage caused directly or indirectly by the applicant's sewer cleaning work. If the bond becomes of no effect for any reason, the license is immediately void.

Cleaning is not tapping

The sewer cleaner license covers cleaning and removing stoppages in building sewers. It does not let the licensee excavate on private or public property, or alter or remove plumbing fixtures, except as the City's ordinances allow. Tapping and connecting to a public sewer is a separate sewer tapper's license under 927.04, which carries its own bond of not less than $25,000.

How the license is issued

Apply in writing to the Director of Public Utilities. The Division of Sewer and Drainage Services examines each applicant's qualifications, and the Director grants the license on the Division's recommendation. The Director's fee sheet lists the Sewer Cleaners License at $150 per year.

Expiration and renewal

Under 927.15 every license stays in effect until February 1 following issuance. Renewal applications can be made 30 days before that date on forms furnished by the Director of Public Utilities. The Division can suspend or revoke a license for violations, and the licensee has five days after the written decision to demand a review hearing before the Director.

Before the bond is issued

Confirm the current bond form and filing steps with the Toledo Department of Public Utilities before the bond is issued.
