Right of Way Permit ($5,000) Bond - City of Stow, OH in Ohio

Brief Summary

A right of way bond in Stow does not stand in for contractor registration. Anyone digging in a street, sidewalk or curb line under a Chapter 901 permit also has to register with the Building Department under Chapter 1317. Posting the $5,000 bond with the City of Stow lets you meet the security requirement without leaving cash on deposit for the life of the job.

The City of Stow requires a permit from the Director of Public Service before anyone excavates in a street, alley, sidewalk or public ground. Under Section 901.04(d) of the Stow Codified Ordinances, the Director can require a cash deposit of at least $100, a bond, or both, to protect the city against damage from the excavation and to cover inspection costs caused by work that does not meet city standards. This page covers the $5,000 right of way permit bond posted with the City of Stow for that purpose.

Detailed Information About the Ohio Right of Way Permit ($5,000) Bond:

Registration is a separate step

This is the part most contractors miss. Section 1317.01 defines a general contractor in Stow to include anyone doing excavation that requires a permit under Chapter 901, construction and repair of sidewalks and driveways, and construction and repair of water lines and sanitary and storm sewers. Section 1317.02 bars anyone from that work until they have registered as a contractor with the Building Department. The right of way bond does not satisfy that registration.

When the permit and bond apply

Section 901.01 requires a permit for any excavation in or on a street, alley, sidewalk or public ground, and for removing the surface of any street within its right of way. Applications go to the office of the Director of Public Service on the city's forms under Section 901.02.

Section 901.04(d) gives the Director the choice of a deposit in whatever amount the Director deems necessary, never less than $100, or a bond, or both. The security indemnifies the city against damage from the excavation and offsets inspection costs that result from work not meeting city standards. If the street is not restored properly, the city can do the work and charge the applicant.

Fees that come with the permit

Section 965.01 lists right of way access permit fees, each marked deposit or bond required:

  • Curb cuts: $60 each
  • Improved drive approaches: $125 each
  • Unimproved drive approaches: $60
  • Storm sewer tap in: $125 each

The same section sets a general right of way deposit or bond of $100 minimum plus any additional amount the Service Director decides, with $300 for a new single family dwelling. Engineering review of improvements in the public right of way runs $17 per $1,000 of projected construction cost, with a $2,750 minimum. Section 901.04 adds a $30 permit fee per utility, and Section 901.01(b) requires a deposit of at least $125 for underground utility improvements.

Who is exempt

Section 901.05 exempts federal, state, county and municipal employees authorized to do the work, and emergencies that require immediate action to protect public health, safety or welfare. Private contractors working for a utility or a property owner are not on that list.

Before the bond is issued

Confirm the current bond form and the amount the Director is requiring for your job with the City of Stow Engineering or Public Service office. The surety prices the bond after reviewing the owner's credit and the business history, and you see the quote before you pay.

Ohio Right of Way Permit ($5,000) Bond FAQs:

Does this bond replace contractor registration in Stow?

No. Section 1317.01 counts excavation under a Chapter 901 permit as contractor work, and Section 1317.02 requires registration with the Building Department before that work starts. You need both.

Is the bond instead of a cash deposit, or in addition to it?

It can be either. Section 901.04(d) lets the Director of Public Service require a deposit of at least $100, a bond, or both. Ask the Engineering or Public Service office which applies to your job.

What does the bond protect?

It protects the City of Stow against damage caused by the excavation and covers inspection costs that come from work not meeting city standards. If the city has to restore the area, the cost is charged back to the permit holder.

Who does not need an excavation permit?

Section 901.05 exempts federal, state, county and municipal employees authorized to do the work, and emergencies needing immediate action to protect public health, safety or welfare.

How much will the bond cost?

The surety sets the premium after reviewing the owner's credit and the business history. You see the quote before you pay.
