Sewer Contractor License ($25,000) Bond - City of Painesville, OH in Ohio

Brief Summary

Painesville will not issue a sewer builder's Certificate of Registration until a $25,000 surety bond on a City Manager approved form is on file, and every license expires December 31 no matter when you registered. Renewing by January 31 keeps the fee at $100 instead of $150, and starting work before you are registered doubles it.

Painesville Codified Ordinances 1308.06 requires every sewer builder to furnish a $25,000 surety bond, on a form approved by the City Manager, before the Building Official issues a Certificate of Registration. The bond holds the City harmless from damage caused by the contractor's negligence and guarantees compliance with the City's Plumbing Code and drainage requirements. Licenses expire December 31 each year. City employees doing their regular duties and contractors on regularly awarded City contracts are exempt from the license requirement.

Detailed Information About the Ohio Sewer Contractor License ($25,000) Bond:

Who needs the license, and who does not

Painesville Codified Ordinances 1308.01 says no person may engage in or work at the business of sewer building in the City without first getting a license from the Building Official. Two groups are exempt: employees of the City performing their regular duties, and contractors performing work on regularly awarded City contracts. Everyone else doing private sewer work in Painesville needs the license and the bond.

Ohio Revised Code 715.27 gives municipalities the power to license sewer tappers and other trades, and Painesville uses that power through Chapter 1308.

The bond does not replace the qualification step

The bond is only part of the application. Under 1308.01(b) each applicant must also do one of the following: provide a copy of a current Sewer Builders License issued by the Lake, Geauga or Cuyahoga County Sanitary Engineer's office, hold a valid Painesville Sewer Builders License issued before the section was adopted, or pass a written sewer builders exam given by the City.

What the $25,000 bond guarantees

Under 1308.06(a) the bond must be on a form approved by the City Manager, in the penal sum of $25,000. It states that the contractor will save the City harmless from all damages arising from the negligence of the contractor or anyone in the contractor's employ. It also guarantees that the contractor will follow the City's Plumbing Code, any other codes incorporated into the Codified Ordinances by reference, the City's other requirements for drainage work, and the directions of the Building Official. The bond is in force from the date it is accepted and the certificate is issued to the end of the year the certificate covers.

Insurance is required too

Section 1308.06(b) requires evidence of liability insurance of $100,000/$300,000 for bodily injury and $50,000 for property damage, at application and at every renewal. If explosives will be used on any job, 1308.06(c) requires a rider or added policy of $50,000 for injury to one person, $100,000 for injury to more than one person and $50,000 for property damage in any one accident.

Fees, expiration and renewal

Under 1308.02 all licenses expire December 31 of each year. The registration fee is $100 if you register or renew by January 31. After that it is $150 from February 1 to August 31, or $75 from September 1 to December 31. If work starts before the contractor is registered, the fee is doubled.

Before the bond is issued

Liability insurance of $100,000/$300,000 for bodily injury and $50,000 for property damage. Jobs that use explosives need an added rider or policy of $50,000 per person, $100,000 for more than one person and $50,000 for property damage.
