Driveway Permit Bond - Town of Lagrange, New York in New York

Brief Summary

In the Town of LaGrange the driveway bond is set by the Highway Superintendent, not printed in the code, and it only covers driveways onto town highways. Get the amount and any special conditions from the Highway Department before you order the bond, and the permit moves without a second trip.

Town of LaGrange Code 199-1 bars anyone from cutting, building or locating a driveway entrance onto a town highway without permission from the Superintendent of Highways, who may impose any special conditions the circumstances call for. This surety bond runs to the Town of LaGrange and guarantees the permittee completes the driveway work in the town right of way to the town's standards and pays for any repairs. Confirm the current bond amount, form and filing steps with the Highway Superintendent before the bond is issued.

Detailed Information About the New York Driveway Permit Bond:

Town highways only

This bond is for driveways that connect to a Town of LaGrange highway. Town Code 199-3 says access onto a state or county highway needs approval from the agency that owns that road, so a driveway onto a county road or state route goes through that agency, not the town.

Who sets the terms

Under 199-1, no person, firm or corporation may cut, construct or locate a driveway entrance or exit onto a town highway without permission from the Superintendent of Highways. Section 199-2 lets the superintendent impose any special conditions required in his judgment, makes the applicant furnish all materials and bear all construction costs within the town right of way, and requires a new permit before any later alteration or relocation. The application fee comes from the fee schedule the Town Board adopts by resolution.

When a curb, sidewalk or gutter is cut

Many driveway jobs also cut a curb. Town Code 199-62 requires a permit and bond to replace, change, alter, raise, lower or cut a curb, sidewalk or gutter. If the work is done and completed within one working day, the Town Board may grant the permit without a bond on the Highway Superintendent's written recommendation, but that waiver does not reach excavations deeper than six inches or work that needs barricades.

Insurance and deposits

Permits under Part 4 of Chapter 199 carry insurance terms in 199-63. The applicant files proof of liability insurance with the Town Clerk with limits of $1,000,000 for each person and $2,000,000 for each occurrence for bodily injury, and $500,000 for each occurrence for property damage, with the Town named as additional insured, for a period of one year after the work is completed. Under 199-58 the Town Board may also require a cash deposit equal to the estimated cost of the work.

What the bond guarantees

The bond runs to the Town of LaGrange. It guarantees that the permittee completes the driveway work in the town right of way to the town's design standards and pays for any repairs to the highway, shoulder or drainage. If that does not happen, the town can claim against the bond, and the surety pays valid claims and recovers the money from the principal.

New York Driveway Permit Bond FAQs:

How much is the LaGrange driveway bond?

Chapter 199 does not print a dollar figure. The Highway Superintendent sets the permit conditions under 199-2, so get the amount from the Highway Department at 845-452-1830 before the bond is issued.

My driveway is on a county road. Do I need this bond?

This bond covers driveways onto town highways. Under Town Code 199-3, access onto a state or county highway needs approval from the agency that owns that road. Check with that agency about its own permit.

Can the bond be waived?

For curb, sidewalk or gutter work, 199-62 lets the Town Board grant the permit without a bond if the work is done and completed within one working day, on the Highway Superintendent's written recommendation. The waiver does not apply to excavations deeper than six inches or work that needs barricades.

What insurance does the town require?

For permits under Part 4, 199-63 requires bodily injury coverage of $1,000,000 for each person and $2,000,000 for each occurrence and property damage coverage of $500,000 for each occurrence, with the Town named as additional insured, kept for one year after the work is completed.

What does the bond cost?

You pay the surety a premium, not the bond amount. It depends on the amount the town requires and on the applicant's credit and finances.
