Solid Waste Collection and Disposal Performance ($10,000) Bond - Fulton County, GA in Georgia

Brief Summary

Before paying for this bond, check two things: whether the route is in unincorporated Fulton County and whether it is residential. Only residential hauling in unincorporated Fulton triggers the $10,000 bond. If yours does, a surety bond meets the requirement for an annual premium and keeps $10,000 out of a letter of credit tied up at your bank.

Fulton County Code Section 70-86(b)(4) requires hauling contractors to post a $10,000 performance bond, or a $10,000 irrevocable letter of credit, with the Department of Public Works before handling solid waste in unincorporated Fulton County. Section 70-87(b) exempts commercial service from the bond, so it applies only to residential collection. The ordinance does not reach haulers working inside Atlanta, South Fulton or any other city.

Detailed Information About the Georgia Solid Waste Collection and Disposal Performance ($10,000) Bond:

Most haulers do not need this bond

Fulton County's solid waste collection rules sit in Chapter 70, Article II, Division 3 of the County Code, and Section 70-84 limits them to unincorporated Fulton County. Since July 3, 2017, planning and zoning for nearly all of the former unincorporated south county has belonged to the City of South Fulton. The piece still handled by Fulton County Public Works is the Fulton Industrial Business District. A hauler serving customers inside any city is outside this ordinance.

Within that area, the bond is limited further. Section 70-87(b) says hauling contractors performing commercial services must still register, but are not required to meet the bonding requirement of Section 70-86(b)(4). The $10,000 bond therefore applies only to residential service in unincorporated Fulton County.

The amount and the alternative

Section 70-86(b)(4) requires every covered hauling contractor, before engaging in solid waste handling, to post a performance bond of $10,000 with the Department of Public Works. The amount is flat. It does not change with fleet size or customer count. The same section allows a $10,000 irrevocable letter of credit instead of the bond.

Registration takes more than the bond

Hauling contractors register with the Department of Public Works and must meet the requirements every year. Registration also requires a solid waste handling permit from the Georgia Environmental Protection Division, a Fulton County Board of Health permit, comprehensive general liability insurance of $500,000, vehicle liability of $500,000 per occurrence covering owned, nonowned and hired vehicles, umbrella liability of $1,000,000, and a certification that the contractor will indemnify and hold the county harmless for claims from its collection operations.

Who is exempt

Section 70-85 exempts residents who dispose of waste from their own home on land they own, or who haul it themselves to a facility they own, as long as the disposal does not invite insects or rodents. It also exempts certain livestock operations within stated capacity limits, composting of yard trimmings, and dead animal disposal handled under state law.

Georgia Solid Waste Collection and Disposal Performance ($10,000) Bond FAQs:

I haul commercial dumpsters in unincorporated Fulton County. Do I need the bond?

No. Section 70-87(b) requires commercial haulers to register but exempts them from the Section 70-86(b)(4) bond. The bond applies to residential service.

Does this bond cover hauling in Atlanta or South Fulton?

No. Section 70-84 limits the division to unincorporated Fulton County. Work inside a city falls under that city's rules.

Can I use a letter of credit instead?

Yes. The code allows a $10,000 irrevocable letter of credit in place of the bond. A surety bond usually leaves your bank credit line free, since the letter of credit ties up $10,000 of it.

Is there a statewide Georgia hauler bond?

Not from this ordinance. Fulton County requires the $10,000 bond locally, and separately requires you to hold a Georgia EPD solid waste handling permit.

How long is the bond good for?

Registration is annual, so keep the bond in force for as long as you are registered and renew it with each registration.

What will the bond cost?

The surety sets the premium based on the $10,000 amount and your company's credit and claims history. The county does not set it. Apply to see your actual quote.
