Performance Bond Bond - Town of Mansfield, CT in Connecticut

Brief Summary

When the Mansfield Planning and Zoning Commission makes a performance bond a condition of approval, the bond stands between you and your permits or Certificate of Compliance. A surety bond meets that condition without parking the full amount in a Town cash account for the life of the project.

The Town of Mansfield Planning and Zoning Commission can require a performance bond as a condition of site plan, special permit or subdivision approval. Under Article V, Section A.6 of the Mansfield Zoning Regulations the bond guarantees satisfactory completion of the approved site work, including erosion and sedimentation control. The Commission sets the amount based on the development and the site, and it may be less than the full cost of the work.

Detailed Information About the Connecticut Performance Bond Bond:

The amount is set project by project

There is no single Mansfield performance bond figure. Article V, Section A.6 of the Mansfield Zoning Regulations lets the Planning and Zoning Commission require a performance bond, a maintenance bond, or a cash bond with a written bond agreement when a development involves new site improvements, extensive grading, filling or earth removal, or an erosion and sedimentation control plan. The Commission sets the amount based on the nature of the development and the site characteristics, and the regulations allow it to be less than the full cost of the site work. The Commission can also ask an applicant for cost estimates for the site improvements and a bonding agreement during review.

What the bond guarantees

The bond ensures the approved site work is completed as approved, including erosion control, and gives the Town funds to deal with erosion or sediment problems. The owner or developer whose project was approved posts it, with the Town of Mansfield as obligee.

Subdivisions and common driveways

The Commission bonds subdivision improvements too. In its November 21, 2022 decision notice, the Commission authorized release of an $8,500 performance bond for a common driveway in the Suave Subdivision once the work was done. Release comes by Commission action, so expect the bond to stay in force until the Commission votes it off.

Maintenance bond and Certificate of Compliance

A performance bond is not always the last instrument. The regulations let the Commission require a maintenance bond before it issues a Certificate of Compliance. It can also issue a certificate early when the public health and safety work is complete and a suitable bond with a written bond agreement covers the remaining site work. Confirm the bond amount, the bond agreement and the accepted form with the Mansfield Planning and Zoning office before the bond is issued.

Eligibility and Requirements for a Connecticut Performance Bond Bond:

  • Bond amount set by the Planning and Zoning Commission for the specific approval.
  • Written bond agreement with the Town.
  • Possible separate maintenance bond before a Certificate of Compliance.
  • Underwriting based on the applicant's credit, finances and the size of the bonded work.
