Firestone will not license a refuse hauler until a $25,000 faithful performance bond is approved by the Town Clerk. A surety bond lets you meet that requirement for an annual premium, so you are not tying up cash, and it renews on the same calendar year cycle as your Firestone license.
Firestone Municipal Code Section 5.36.030 requires every licensed refuse hauler to post a $25,000 faithful performance bond, conditioned on following Town ordinances and other applicable law, in a form approved by the Town Clerk. The Clerk may accept a $5,000 cash deposit instead. Haulers working under a contract with the Town that indemnifies it are exempt from the fee, bond and deposit. Licenses run by calendar year and renew by December 31.

Chapter 5.36 of the Firestone Municipal Code covers anyone who collects or hauls refuse over any street, alley or public place in the Town. Refuse includes trash, garbage, ashes, yard debris such as leaves, grass and limbs, and discarded cans, bottles and paper from homes, businesses and industrial sites. A person hauling refuse from their own property in their own vehicle is not a refuse hauler under the code.
The one real exemption is for haulers under contract with the Town. Section 5.36.030 waives the license fee, the bond and the cash deposit for a contract hauler, as long as the contract includes an indemnification provision protecting the Town from bodily injury and property damage claims. Every other hauler posts the bond.
The bond is a faithful performance bond of $25,000. It is conditioned on the licensee, and its officers, employees and agents, complying with Town ordinances, resolutions and rules and other applicable laws, and it must be in a form approved by the Town Clerk. The Clerk has discretion to take a $5,000 cash deposit in place of the bond, which the Town can draw on to cover failures to perform. Most haulers would rather pay a premium than leave cash on deposit with the Town.
The chapter spells out the conduct the bond stands behind. Refuse may be dumped only at approved disposal sites. Trucks may not damage Town streets, alleys or curbs beyond ordinary wear and tear, or damage public or private property. Every vehicle needs a permanent cover over the open body, a leakproof body, and permanent sideboards and tailgate. Collection in residential districts is limited to 7:00 a.m. to 7:00 p.m., Monday through Friday, and in nonresidential districts to 7:00 a.m. to 10:00 p.m., Monday through Friday, with Saturday pickup only after a Town holiday week or with advance weather approval from the Town Manager. Trucks of 6,000 pounds gross vehicle weight or more are held to 86 dB(A). Spilled refuse must be picked up promptly. The Clerk can refuse to issue or renew a license over unsafe equipment, unapproved dumping, or unlicensed drivers.
Application is made annually on Town forms through the Firestone online portal, choosing the Refuse Haulers sub category. The Town's business license page lists a $60 fee for a new or renewal license. Licenses are issued by calendar year and must be renewed on or before December 31. Under Resolution 25-108 the fee goes up $15 for every 30 days late.
You pay an annual premium, not the $25,000 face amount. The surety prices it after reviewing the owner's credit and business history. Confirm the current bond form with the Firestone Town Clerk before the bond is issued.
Two. The Town Clerk may accept a $5,000 cash deposit instead of the bond. And a hauler under contract with the Town is exempt from the fee, bond and deposit if the contract includes an indemnification provision protecting the Town.
The bond backs compliance with Town ordinances and other applicable law. Chapter 5.36 rules include dumping only at approved sites, not damaging streets, curbs or private property, covered and leakproof trucks, set collection hours and prompt cleanup of spills.
Firestone business licenses are issued each calendar year and must be renewed on or before December 31. The renewal fee increases $15 for every 30 days late under Resolution 25-108. Keep the bond continuous through each renewal.
No. The code's definition of refuse hauler excludes a person removing refuse from their own property in their own vehicle.
