Aspen's two year guarantee does not run from the day the bond is signed. It runs from the date of the final Inspection Log showing the right of way work 100% satisfactorily complete, and the City releases the bond only after the work passes a second inspection two years later. Plan the bond around that full stretch and it will not lapse before the City is finished with it.
The City of Aspen requires a maintenance bond with a Right of Way permit for excavation or alteration in the public right of way. The amount is the value of the work or $2,500, whichever is greater. Written on the City's form ENG-Policy-205-A with the Single project box checked, it guarantees the contractor will repair or replace defects in the permitted work for two years, and it is released after the City's two year inspection.

Aspen requires a Right of Way permit when a project involves excavation or any type of alteration in the public right of way. The City lists examples such as installing utility lines, repairing or building sidewalks and driveways, extensive landscaping including hardscape in the right of way, and earth retention systems that extend into the right of way. The maintenance bond is submitted with the permit application along with a site plan and a traffic control plan stamped by a traffic control supervisor.
The bond must equal the value of the work being done or $2,500, whichever is greater. The City's bond form uses the same test, the greater of $2,500 or the total value of work to be performed. Work valued at $18,000 needs an $18,000 bond. Work valued at $1,200 still needs a $2,500 bond.
The City's Maintenance Bond form, ENG-Policy-205-A, offers three categories: Single project, Multiple Occurrence Work and Blanket Coverage, and only one may be checked. This page covers the Single project version, which backs the work described in one right of way permit.
The form guarantees the work for a period of two years from the date of issuance of the final Inspection Log indicating 100% satisfactory completion of work. On the City's side this is called probationary acceptance. The clock starts that day and the applicant receives an email notification. The form also makes the bond non-cancelable for two full years from the date of issuance. At the two year mark the City inspects again. If the work passes, the maintenance bond is released and the permit is closed.
The contractor promises that the workmanship on the permitted work will be free from all defects and in continuous good order and in a condition satisfactory to the Governing Body of the City of Aspen for two years, and that it will repair or replace all defects during that period. If the contractor does not, the City can look to the bond.
The City lists a Right of Way application fee of $401.70, a Parks Department review fee of $74 for minor projects with an additional $73 for projects over $50,000, and an Earth Retention Impact Fee of $1.40 per cubic foot where it applies. These are permit fees paid to the City, not the bond premium. The premium is set by the surety based on the bond amount, the length of the obligation and the contractor's credit and financial history.
On the date of the final Inspection Log showing the work 100% satisfactorily complete. The City calls this probationary acceptance and sends the applicant an email notification when it starts.
$2,500. If the work in the right of way is worth more than that, the bond must equal the value of the work.
No. The City's form makes the bond non-cancelable for two full years from the date of issuance.
The City inspects the work at the two year mark. If it passes, the maintenance bond is released and the Right of Way permit is closed.
Check Single project when the bond backs the work in one permit. Multiple Occurrence Work and Blanket Coverage are separate categories on the same form, and only one box may be checked.
