Nevada County will not accept a commercial cannabis Administrative Development Permit application without proof of $5,000 in security the county can draw on. A bond covers that line item for a premium, so the $5,000 stays in your operation instead of sitting in a certificate of deposit.
Nevada County Code section 12.03.300 requires every applicant for a commercial cannabis Administrative Development Permit (ADP) to provide proof of a certificate of deposit or bond in the amount of $5,000, approved by the Enforcing Officer and accessible by the County of Nevada. The amount is a single flat figure. Applications go to the Nevada County Planning Department.

Commercial cannabis activity in unincorporated Nevada County takes two permits under County Code 12.03.300. First comes the Administrative Development Permit (ADP), then the Annual Cannabis Permit (ACP). The $5,000 security is listed among the items that must be submitted with the ADP application, at subsection G.1.b.xxi. If an ACP is not obtained within six months of ADP issuance, or the ACP is revoked or denied renewal, the county may move to revoke the ADP. The ACP renews every year.
The applicant must provide proof of purchase of a certificate of deposit or bond in the amount of $5,000, approved by the Enforcing Officer, which may be accessed by the County of Nevada. The amount does not change with canopy size or license type. The county is the party protected, and it can draw on the security if the operator leaves obligations under the permit unmet.
The code language refers to a certificate of deposit or bond from a commercial banking institution approved by the Enforcing Officer. Confirm with the Planning Department that a surety bond is acceptable for your application, how the County of Nevada should be named, and whether the county has a form it wants used. Then have the bond issued to match.
New ADPs, ADP amendments and resubmittals go to the Nevada County Planning Department at 950 Maidu Avenue in Nevada City, 530-265-1222 option 2, along with the rest of the ADP packet.
No. Section 12.03.300 sets one figure of $5,000 for every ADP applicant, regardless of canopy or activity type.
Yes. The code allows a certificate of deposit or bond in the amount of $5,000. A bond lets you meet the requirement without tying up the cash.
With your Administrative Development Permit application. Proof of the certificate of deposit or bond is one of the listed submittal items.
You pay an annual premium rather than the full $5,000. The surety sets it from the bond amount and the applicant's credit, and you see the quote before you buy.
