Wage and Welfare ($25,000) Bond - District Council of Iron Workers in California

Brief Summary

Union iron work in California does not start until the $25,000 wage and welfare bond is posted. If it is missing, the union can refuse to dispatch ironworkers to your job or pull the crew already there. A surety bond meets the requirement for a yearly premium instead of $25,000 in cash.

Section 22 of the master agreement between the Iron Worker Employers of California and part of Nevada and the District Council of Iron Workers of the State of California and Vicinity requires each employer performing covered work to post a $25,000 surety bond, or a cash bond, before work begins. The bond guarantees payment of wages and contributions to the iron workers trust funds named in the agreement.

Detailed Information About the California Wage and Welfare ($25,000) Bond:

Post it before the first shift

The agreement is clear on timing. Section 22 says the employer must post the bond prior to commencing work under the agreement. An employer that has not complied can be refused workers by the union, and the union can withdraw workers already on the job without breaching the agreement.

What the bond guarantees

The $25,000 bond secures payment of wages and of the fringe benefit contributions owed to the trust funds listed in the agreement. Contributions are due on the 15th of the month after the month the ironworkers were paid or worked, and they become delinquent if the trust funds have not received them by the 25th. Bonding is administered under the California Field Iron Workers Labor Management Cooperative Trust.

When you may owe more than $25,000

An employer that falls behind on contributions can be required to furnish an additional bond in an amount set by the Trust Fund Delinquency Committee. There is a built in protection for good payers. A current employer that has not been delinquent for 24 consecutive months is exempt from having to increase its existing bond.

Audits

The trust funds can send an auditor to review payroll records. If the audit finds underpaid contributions that are not clerical errors, the employer pays for the audit along with the unpaid benefits, liquidated damages and attorney fees.

Before you order the bond

The copy of the agreement relied on here runs July 1, 2020 through December 31, 2024. Confirm the current amount, obligee wording and filing address with the District Council or the trust fund office before the bond is issued.
