Land Use Permit Bond - North Slope Borough in Alaska

Brief Summary

The North Slope Borough can make surety a condition of your land use permit before you move any gravel or set up camp. Having the bond ready when the Land Management Regulation Division asks for it keeps your permit on schedule in a place where the work season is short and a missed window can cost you a year.

Under North Slope Borough Municipal Code 19.30.070(A), the Administrator or the Planning or Zoning Commission may require surety before a permitted use or development begins. The Borough sets the form and amount based on the size, type, cost and duration of the work, and the amount may not exceed 100% of the estimated cost of reclamation or mitigation. Commercial recreation permits with structures, roads, runways or fuel or chemical storage call for a $25,000 bond.

Detailed Information About the Alaska Land Use Permit Bond:

The amount depends on your project

There is no single bond figure for every North Slope Borough land use permit. NSBMC 19.30.070(A)(1) has the Borough set the form and amount of surety based on the magnitude, type and costs of the planned activities and the nature, extent and duration of the operations. The amount must be reasonably related to that work and cannot exceed 100% of the estimated cost of reclamation or mitigation. A small study camp and an industrial pad with a fuel farm will not be bonded at the same level.

The Borough's Form 200 instructions for commercial recreation operators, such as guides, outfitters, flying services, lodges and Dalton Highway roadside businesses, state a $25,000 surety bond under 19.30.070(A) for permits that include structures, roads, runways and fuel or chemical storage. That bond gives the Borough funds to reclaim or mitigate damage caused by the operation.

Who needs a permit

NSBMC 19.50.010 requires approval before any use or development defined in Title 19 begins anywhere in the Borough. That reaches village districts, the Conservation, Resource Development, Transportation Corridor and Scientific Research districts, and Utqiagvik. Surety is required case by case as a condition of approval, so the Land Management Regulation Division will tell you if and how much.

Other ways to meet the requirement

Under 19.30.070(A)(3) the Borough may accept evidence of self insurance, proof of financial responsibility, or sufficient surety already filed with another government agency. Operators who already post reclamation bonds with the state or federal government should raise this early.

How long the bond stays in place

Liability continues until the Administrator releases the surety in whole or in part. A reclamation plan may also be required as a condition of approval, and the bond is what backs it.

Filing changes in 2026

Since March 2026, all NSB Planning permit applications are filed electronically through the North Slope AK Portal. The Borough's fee schedule effective January 1, 2026 supersedes the fee amounts printed in older instructions, and fees double for permits filed after work has already begun.

Alaska Land Use Permit Bond FAQs:

How much bond will the Borough require?

It depends on the project. NSBMC 19.30.070(A) ties the amount to the size, cost and duration of the work and caps it at 100% of the estimated reclamation or mitigation cost. Commercial recreation permits with structures, roads, runways or fuel or chemical storage call for $25,000.

We already have a reclamation bond with the state. Do we need another one?

Maybe not. The code lets the Borough accept sufficient surety already filed with another governmental entity, self insurance or proof of financial responsibility. Ask the Land Management Regulation Division whether your existing bond will be accepted.

When does the bond get released?

Liability continues until the Administrator releases it, in part or in full, usually once reclamation or mitigation is complete.

Is the bond the same as the insurance for commercial recreation permits?

No. Commercial recreation operators also provide a $100,000 liability policy naming the Borough as beneficiary, or proof of their own emergency service capability, in addition to any surety bond.

What will the bond cost?

You pay a premium, not the face amount. The surety prices it on your credit, financial strength and the reclamation work the bond backs, so a quote is the quickest way to know your cost.
