Detailed Information About the Oregon Residential Locksmith Services Contractor ($15,000) Bond:

The name alone triggers the law

ORS 701.480(3) and (4) say a person may not use the title locksmith, locksmith professional, commercial locksmith, lock installer or any similar title, or any sign, card or device suggesting locksmith services, unless the person is a certified locksmith or a CCB licensed business with a certified owner or employee. A van with a lock logo and a phone number is enough to need the license.

Who needs it

ORS 701.475 defines a locksmith as a person who services, installs, repairs, rebuilds, rekeys, repins or adjusts locks, hardware peripheral to locks, safes, vaults, safe deposit boxes or mechanical or electronic security systems. Under ORS 701.480 the individual must be certified by the CCB and work for a licensed business, and the business must be licensed and have a certified owner or employee. OAR 812-003-0131(5) lets the endorsement holder provide locksmith services for residential or small commercial structures and bars any other contractor activities.

Exemptions in ORS 701.490

The certification and conduct rules do not apply to several groups, including a person offering key duplication at a fixed location or alongside other business who does not offer other locksmith services, property owners and their regular employees working on their own property, landlords and their agents, and lock manufacturers. A licensed construction contractor working within its own license is also exempt, provided it does not hold itself out as a locksmith.

How the bond works

The amount is a flat $15,000. ORS 701.068 requires a corporate surety authorized in Oregon, and the bond pays amounts the board determines on complaints under ORS 701.145. It runs at least one year or until depleted and may be continued by certificate without raising the limit. The board can require up to five times the normal amount for reinstatement after a suspension or under conditions set by rule.

Oregon Residential Locksmith Services Contractor ($15,000) Bond FAQs:

What does the locksmith certification test involve?

The CCB describes an 80 question online test with a $60 fee, and allows reference books during the test. Certification is for two years, and it must be associated with a CCB residential contractor license.

I only cut keys at my hardware counter. Do I need this?

ORS 701.490 exempts a person offering key duplication at a fixed location or as part of other business activities, as long as the person does not offer other locksmith services.

Can a locksmith business also install doors or do other carpentry?

Not on this endorsement. OAR 812-003-0131(5) bars the holder from any other contractor activities.

How long does the bond stay in force?

At least one year or until depleted by payments, unless the surety cancels sooner. The surety can continue it by continuation certificate, and the total payout across all years remains capped at $15,000.

What decides my premium?

The surety reviews the owners, mainly credit and business history, and quotes a premium from that. The $15,000 is the bond limit, not the price.
