Home Services Contractor ($15,000) Bond - Statewide in Oregon

Brief Summary

Home warranty companies are often surprised that Oregon licenses them at all, since the repair itself is done by someone else. The Home Services Contractor endorsement is how the Construction Contractors Board covers that business, and this $15,000 bond goes in with the application. There is no prelicense test to pass, so the bond and insurance are most of the work.

ORS 701.081(7) requires an Oregon Home Services Contractor to file a $15,000 surety bond with the Construction Contractors Board and carry at least $100,000 in general liability insurance. The endorsement is for businesses that provide service, repair or replacement under a home service agreement, the contract most people call a home warranty, and it allows no other contractor work.

Detailed Information About the Oregon Home Services Contractor ($15,000) Bond:

Who this endorsement is for

ORS 701.501(2) says a home services contractor license authorizes the holder to operate a business providing service, repair or replacement for homes through a licensed contractor under a home service agreement. The terms home and home service agreement come from ORS 731.164, which describes a contract of limited duration to service, repair or replace home systems or appliances that fail from normal wear or defects, and in some cases incidental repair of roof leaks. The CCB endorsement chart lists the scope as home warranty services only.

The structure matters. The warranty business holds this endorsement, and the service calls go out through a licensed contractor. OAR 812-003-0131(7) says the holder may not engage in any other contractor activities, so a warranty company that also wants its own crews doing general repair work is outside this endorsement.

Lighter entry requirements

This is one of the few CCB endorsements with no test. ORS 701.501(4) bars the board from requiring a home services contractor to take the business practices and law test, and ORS 701.501(3) bars a continuing education requirement. Unlike the residential general, specialty and limited endorsements, ORS 701.081(7) does not call for a responsible managing individual. The bond and the insurance are the two financial requirements.

How the bond works

The amount is a flat $15,000. ORS 701.068 requires a corporate surety authorized in Oregon and says the bond pays amounts the board determines on complaints under ORS 701.145. It stays in effect for at least one year or until depleted, and may be continued by continuation certificate without raising the limit. The board can require up to five times the normal amount for reinstatement after a suspension or under conditions set by rule.

Oregon Home Services Contractor ($15,000) Bond FAQs:

We never send our own technicians. Do we still need this?

ORS 701.501(2) describes the license as covering a business that provides service, repair or replacement through a licensed contractor under a home service agreement. Using outside contractors is the model the endorsement is built around.

Is there an exam?

No. ORS 701.501(4) says the board may not require a home services contractor to take the business practices and law test, and the CCB lists the prelicense training and test for this endorsement as none.

Can our company do other repair or remodeling jobs on this license?

No. OAR 812-003-0131(7) limits the holder to work under home service agreements and bars any other contractor activities.

Who can claim against the bond?

Claims run through the CCB complaint process. The bond exists only to pay amounts the board determines the surety owes, per ORS 701.068(7).

How is the premium figured?

The surety prices the bond after reviewing the company and its owners, mostly credit and financial history. The $15,000 is the payout ceiling, not the cost.
