Brief Summary
If your business resells Oregon DMV driver or vehicle record information, the $25,000 performance bond is part of the price of admission. Oregon will not sign a disseminator contract without it. You pay an annual premium instead of setting aside $25,000, and the bond goes to Oregon DMV with your contract paperwork.
Under ORS 802.179(13), a business that disseminates personal information from Oregon DMV records must file a $25,000 performance bond with the Department of Transportation and enter into a contract with DMV. The bond runs in favor of the State of Oregon, its form is subject to Attorney General approval, and the contract limits the business to individual record inquiries for authorized recipients rather than bulk distribution.

Detailed Information About the Oregon Disseminator Contract ($25,000) Bond:
Who has to post this bond
Oregon DMV releases personal information from driver and vehicle records only to people and businesses that qualify under ORS 802.175 to 802.191. A disseminator is a business that takes that information and resells or rediscloses it to others, such as a records vendor serving employers, insurers or investigators.
ORS 802.179(13) requires a person in the business of disseminating personal information to file a $25,000 performance bond with the department and to sign a contract with DMV. The bond is executed in favor of the State of Oregon and its form is subject to approval by the Attorney General. The amount is flat. It does not change with the number of customers or records you handle.
What the contract requires
The statute spells out the core terms. The disseminator provides information only in response to individual record inquiries, not in bulk, and only to persons or agencies authorized to receive it. ORS 802.181 and OAR 735-010-0240 allow resale or redisclosure only to recipients DMV has authorized, and require the disseminator to keep records for five years showing who received each record and the permitted purpose.
Getting approved by DMV
OAR 735-010-0215 lists what DMV reviews before treating a business as a disseminator: proof that it is a legitimate business, a description of the business, the method it uses to make sure information goes only to authorized recipients, current advertising, and customer references DMV can call. DMV may ask for updates later to monitor compliance.
