The Cemetery and Funeral Bureau will not license an individual cemetery broker without a $10,000 surety bond on its own bond form. The bond is conditioned on the conduct of the broker's salespeople and employees as well as the broker, so the broker's one filing stands behind the sales staff too.
An individual applying for a California cemetery broker license must post a $10,000 surety bond with the Cemetery and Funeral Bureau. The Bureau's form names the People of the State of California as obligee and guarantees that the broker, and the broker's salespeople and employees, honestly perform their undertakings and apply all money received as required. The license runs one year and renews at $560.

Cemetery salespeople are licensed under an employing broker, and the bond sits on the broker license. The Bureau's bond form is conditioned on the broker's salespeople and employees meeting their obligations as well as the broker, so their conduct falls under the broker's $10,000. The Bureau's checklist ties the bond to the individual broker license. Corporations, partnerships and associations have their own document lists, such as certified corporate minutes or partnership articles, so ask the Bureau which items your entity files before submitting.
The Bureau's surety bond form, revised 04/23, binds the principal and surety to the People of the State of California for $10,000, with aggregate liability capped at $10,000. It is conditioned on the broker honestly and faithfully performing all undertakings entered into as a licensed cemetery broker and honestly and faithfully applying all sums received. It refers to Chapter 12 of Division 3 of the Business and Professions Code, Division 8 of the Health and Safety Code relating to cemeteries, and the Civil Code. The surety can cancel with 30 days' written notice to the Cemetery and Funeral Bureau.
Applications are made in writing on the Bureau's form under Business and Professions Code 7651 and come with the original broker license fee. The Bureau lists a $750 application and examination fee, a one-year license term, a $560 annual renewal and an $840 delinquent renewal. Applicants need two years as a cemetery salesperson or equivalent cemetery experience, California residency, Live Scan fingerprinting and a passing score on the broker examination. An application is abandoned if the exam is not taken within six months of the eligibility notice.
The Bureau's checklist lists the $10,000 bond for the broker license, and salespeople are licensed under the broker who employs them. The broker's bond is conditioned on its salespeople and employees performing their obligations too.
The Bureau ties the bond to the individual broker license and asks corporate applicants for certified minutes authorizing the application. Confirm with the Bureau which documents and bond your entity submits before you file.
The bond runs to the People of the State of California. It covers the broker's failure to honestly perform cemetery broker undertakings or to properly apply money received, including failures by the broker's salespeople and employees.
One year. The annual renewal fee is $560, and a delinquent renewal is $840.
The surety reviews the broker's credit and background and quotes a price for the $10,000 bond. The bond amount is fixed by the Bureau and does not change with the quote.
